These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "User," or "Seller") and West Sound LLC, a Washington limited liability company, doing business as West Sound Buyers ("Company," "we," "us," or "our"), governing your access to and use of our website, contact forms, property submission tools, email communications, and related services (collectively, the "Services").
West Sound Buyers provides an online platform through which property owners may submit information about real property for the purpose of receiving a potential cash purchase offer from the Company or its assigns. The Company operates as a real estate investor and/or wholesaler and may purchase property directly, assign its purchase rights to a third-party buyer, or decline to make an offer at its sole discretion.
The Company is not a licensed real estate broker, agent, or salesperson in the State of Washington or any other jurisdiction, and does not act as a fiduciary, agent, or representative of any property owner. Nothing on the Services constitutes real estate brokerage services, legal advice, financial advice, or tax advice. You are encouraged to consult a licensed real estate professional, attorney, and/or tax advisor before entering into any transaction involving your property.
Submission of a contact form, property details, or any other information through the Services does not guarantee that you will receive an offer, and does not obligate the Company to make an offer, extend any specific price, or purchase your property. Any offer, if made, is non-binding until reduced to a separate, signed written purchase agreement executed by an authorized representative of the Company. The Company reserves the right to rescind, modify, or decline to honor any preliminary or verbal offer at any time prior to execution of a definitive written agreement.
Any property purchase made by the Company is made strictly on an "as-is, where-is" basis, without any warranty, representation, or guarantee, express or implied, as to the condition, habitability, marketability, or fitness for any particular purpose of the property. Any final purchase terms, inspection contingencies, or closing conditions will be governed exclusively by the separate written purchase and sale agreement, not by these Terms.
By using the Services, you represent that you are at least 18 years of age and have the legal capacity and authority (or are acting on behalf of someone with such authority) to submit information about the property in question. You agree that all information you submit — including contact details, property condition, ownership status, and related details — is true, current, and accurate to the best of your knowledge. The Company is not responsible for decisions made in reliance on inaccurate or incomplete information you provide.
By submitting a contact form, property information, or signing up for email communications, you expressly consent to be contacted by the Company and its representatives via phone call, text message (SMS/MMS), and email — including through automated dialing systems, pre-recorded messages, or automated text platforms — at the phone number(s) and email address(es) you provide, even if that number is registered on a state or national Do-Not-Call list. Message and data rates may apply. Consent to receive communications is not a condition of any purchase. You may opt out of text messages at any time by replying "STOP," and may unsubscribe from emails using the unsubscribe link provided in each message. You may revoke phone consent by notifying us directly using the contact information below.
Any information, photos, or property details you submit through the Services may be used internally by the Company and its affiliates, assigns, contractors, and business partners for the sole purpose of evaluating and facilitating a potential property purchase. You represent that you have the right to submit any such information and, where applicable, any images of the property.
All content on the Services — including text, graphics, logos, the "West Sound Buyers" name and branding, and website design — is the property of West Sound LLC or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Services without prior written consent.
You agree not to: (a) submit false, fraudulent, or misleading property or contact information; (b) use the Services for any unlawful purpose; (c) attempt to interfere with, disrupt, or gain unauthorized access to the Services or related systems; (d) scrape, harvest, or collect data from the Services using automated means; or (e) impersonate any person or entity, or misrepresent your ownership or authority over any property submitted.
The Services may contain links to third-party websites or resources. The Company does not endorse and is not responsible for the content, accuracy, or practices of any third-party site. Access to any linked third-party site is at your own risk.

The services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. the company does not warrant that the services will be uninterrupted, secure, or error-free, or that any offer communicated through the services will result in a completed transaction.
To the fullest extent permitted by washington law, in no event shall west sound llc, its members, managers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the services, any offer made or not made, or any transaction (or non-transaction) involving your property, even if advised of the possibility of such damages. in no event shall the company's total aggregate liability arising out of or relating to these terms or the services exceed one hundred dollars ($100.00).
You agree to indemnify, defend, and hold harmless West Sound LLC, its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; (c) any inaccurate or fraudulent information you submit; or (d) your violation of any rights of a third party.
15.1 Agreement to Arbitrate. You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any interaction with the Company (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if it qualifies.
15.2 Arbitration Rules. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, and shall be conducted in Kitsap County, Washington, or another mutually agreed location, or by telephone/videoconference where permitted. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15.3 Class Action and Jury Trial Waiver. You and the company agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, collective, consolidated, or representative action. you and the company each waive any right to a jury trial.
15.4 Opt-Out. You may opt out of this arbitration agreement by sending written notice to the Company's email below within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-laws principles. To the extent any dispute is not subject to arbitration, exclusive jurisdiction and venue shall lie in the state or federal courts located in Kitsap County, Washington, and you consent to personal jurisdiction there.
The Company reserves the right to suspend or terminate your access to the Services at any time, without notice, for any reason, including suspected violation of these Terms.
The Company may modify these Terms at any time by posting the revised version on this page with an updated effective date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any executed purchase agreement, constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings, whether written or oral.
